MEMBERSHIP TERMS AND CONDITIONS

 

The Travel Center Experiences program is powered by Arrivia, Inc. These Travel Center Experiences Terms and Conditions (“Terms and Conditions”) set forth a legally binding agreement between Arrivia, Inc., d.b.a. Our Vacation Center (“OVC”) and its affiliates (collectively, “Arrivia”, “We”, “Us”, or “Our”) and each Travel Center Experiences member (“Member”, “Subscriber”, “Traveler”, or “You”) who purchases products and services through Travel Center Experiences.  Please review these Terms and Conditions thoroughly as well as all terms and conditions and policies and procedures supplied by the provider of any product or service offered through TCE (collectively “Provider Terms”). By purchasing products and services through TCE, Member acknowledges and agrees to be bound by these Terms and Conditions, Provider Terms and the terms and conditions of the TCE subscription membership (“Membership”), which are incorporated herein, and Member accepts these Terms and Conditions on the behalf of any traveling companion(s), and/or guests (including minors and those under any disability) (collectively “Guests”). Additionally, Member agrees that it is Member’s sole responsibility to inform any traveling companion(s), guests, or the users of any product or service purchased through TCE of the contents of these Terms and Conditions and all applicable Provider Terms.

NO MEMBER SHOULD RELY UPON REPRESENTATIONS OTHER THAN THOSE INCLUDED IN THIS CONTRACT.

FULFILLMENT SERVICES

 

TCE purchases, benefits and transactions are administered and fulfilled by Arrivia, Inc., d.b.a. Arrivia and d.b.a. Our Vacation Center (“OVS”) , under contract with Travel Center Group, LLC d.b.a Travel Center Experiences. Arrivia is located at 7720 N. Dobson Rd., Scottsdale, AZ 85256. Arrivia is a registered seller of travel in the following states: Florida #ST-29452, Washington UBI#602 443 155 001 0001, Hawaii #TAR-5192 and California #CST 2066521-50. Arrivia is not a participant in the California Travel Restitution Fund. California requires certain sellers of travel to have a trust account or bond. Arrivia maintains a Consumer Protection Bond issued by International Fidelity Insurance Company in the amount of $100,000.00.

Correspondence, including tickets and confirmations, will originate from OVC. Credit/debit card purchases may also result in a charge to purchaser’s credit/debit card from OVC for both the deposit and any subsequent payments including any booking fees for transactions as identified during the travel purchase. Travel insurance plans are administered by Customized Services Administrators, Inc., CA Lic. No. 821931, located in San Diego, CA and doing business as CSA Travel Protection and Insurance Services. Plans are available to residents of the U.S. but may not be available in all jurisdictions. Benefits and services are described on a general basis; certain conditions and exclusions apply. Travel Retailers may not be licensed to sell insurance, in all states, and are not authorized to answer technical questions about the benefits, exclusions, and conditions of this insurance and cannot evaluate the adequacy of your existing insurance. This plan provides insurance coverage for your trip that applies only during the covered trip. You may have coverage from other sources that provides you with similar benefits but may be subject to different restrictions depending upon your other coverages. You may wish to compare the terms of this policy with your existing life, health, home and automobile policies. The purchase of this plan is not required in order to purchase any other travel product or service offered to you by your travel retailers. If you have any questions about your current coverage, call your insurer, insurance agent or broker. This notice provides general information on CSA’s products and services only. The information contained herein is not part of an insurance policy and may not be used to modify any insurance policy that might be issued. In the event the actual policy forms are inconsistent with any information provided herein, the language of the policy forms shall govern.

Travel insurance plans are underwritten by: Generali U.S. Branch, New York, NY; NAIC # 11231. Generali US Branch operates under the following names: Generali Assicurazioni Generali S.P.A. (U.S. Branch) in California, Assicurazioni Generali – U.S. Branch in Colorado, Generali U.S. Branch DBA The General Insurance Company of Trieste & Venice in Oregon, and The General Insurance Company of Trieste and Venice – U.S. Branch in Virginia. Generali US Branch is admitted or licensed to do business in all states and the District of Columbia.

Please thoroughly review these terms and conditions, as well as the purchase receipt. As the addressee, you are the only recipient of this receipt, and it is your responsibility to inform all other parties either listed or traveling with you on the cruise, about these Terms & Conditions. Multiple receipts will not be issued. All cruise line terms and conditions, including but not limited to any cancellation rules are incorporated herein by reference.

Passengers’ Legal Names. Passenger names must reflect complete legal names as they appear on proof of citizenship. Those on honeymoon cruises should consider that fact that their travel documents (proof of citizenship) will be in maiden names and cruise documents must match.

Verify All Information. Please verify all reservation information for accuracy and completeness, and check the spelling of all names carefully. Notify Our Vacation Center (“OVC”) immediately if any changes or corrections are needed.

Read the Cruise Line’s Terms and Conditions Carefully. Each cruise line has its own terms and conditions and brochure’s that outline important information concerning your vacation, in particular policies concerning cancellation penalties, as they may apply. If applicable, locate your cabin to verify its location and bedding options. Compare ship, sailing dates, and itinerary on this receipt with the cruise lines’ current brochure for accuracy. Cruise line brochures may be requested through the Club Concierge Department.

Proof of Citizenship/Travel Requirements. Proof of citizenship is required for all travel outside the United States. In most cases, U.S. and Canadian citizens need a valid passport or certified copy of their birth certificate with a raised seal and photo ID. Non-U.S. citizens must contact their government embassy concerning specific travel documentation requirements for the countries to be visited.

Prices And Rates. The price of products and services, and rates listed for each travel product are based on the terms and conditions of the actual product description within each individual transaction. Government fees, fuel surcharges, and taxes are additional, unless otherwise stated. Travel product rates/prices are based on availability and subject to change without notice. Additional fees may apply. Special rates/prices may not be applicable with other offers or promotions. All offers and upgrades are for selected dates and are subject to availability. Other restrictions may apply. All rates/prices and dates may not be available at time of booking. All information is subject to change without notice. In addition, all travel providers retain certain rights to increase fares and rates (including, without limitation, taxes, service charges, airport charges, and government fees), modify itineraries, change availability, and changes and/or discontinue promotions and/or special offers, at any time for any reason. Any increase in rate/price imposed by the travel provider will be passed on to Member, and Member agrees to the increase, unless otherwise stated in the terms and conditions of the individual travel transaction.

Hotel Taxes And Fees. To facilitate your transactions with Us, We will charge your payment method for “Taxes and Fees.” “Taxes and Fees” includes the estimated total that we will pay to the hotel or supplier for taxes and government fees it owes related to your booking, including but not limited to, sales and use tax, occupancy tax, room tax, excise tax, value added tax, and/or other similar taxes. The amount paid to the supplier for taxes and fees may be less than the amount We estimate and charge to You. The balance of the charge for Taxes and Fees is a service fee We retain as part of the compensation for Our services and to cover Our costs for making reservations, including, for example, customer service costs. We may also include Our service fee in the Taxes and Fees section, which is a fee You paid to Us. The charge for Taxes and Fees varies based on a number of factors including, without limitation, the amount we pay the hotel and the location of the hotel where you will be staying and may include profit that We retain.

Depending on the type of booking You make through Us, You may be charged additional fees by Our travel providers, including, but not limited to:

  1. Certain mandatory hotel specific service fees, including but not limited to: resort fees, energy surcharges, newspaper delivery fees, in-room safe fees, tourism fees, security deposits and/or housekeeping fees;
  2. Certain optional incidental fees, including but not limited to: parking charges, minibar charges, phone use charges, room service charges and/or movie rentals; and
  3. Specialty dining, show fees, drink package costs, and/or additional activity costs.

Our travel providers may require you to put a payment method on file upon check in to pay these and/or other charges directly to the travel provider upon check out. Contact the travel provider directly to determine what charges apply to your reservation.

Additionally, travel providers may charge destination marketing fees that are collected by the hotel for payment to a local tourist bureau. If you are a citizen of a country you travel to, you may owe additional taxes to the hotel at check out.

Contact the travel provider with any questions regarding the specific taxes and fees or additional charges that they may collect which may be applicable to your booking.

Transaction Fees

  1. Processing and servicing fees may be charged and are subject to change, from time to time, at the sole discretion of OVC without prior notice. The processing and service fees will be outlined during the booking process and on your receipt. Additional service fees may also be charged.
  2. A call center fee will be charged per booking for car and hotel, ONLY when you call Us to book or arrange travel. You can avoid the call center fee by booking your car and hotel online through the website. The call center fee may vary based on your membership type, and the call center fee may vary from time to time at the Our sole discretion.
  3. Depending on the type of the term of Your membership, the redemption of certificates may be limited until certain monthly Subscription Fees have been paid as detailed on the Enrollment under Certificate Redemption Limitations, as applicable.
  4. If any certificate is issued to you as part of a subscription renewal, or otherwise, may require a redemption fee that will be charged when booking the respective travel. The redemption fee may vary from time to time at Our sole discretion. See the Certificate for full terms and conditions related to the activation, redemption, and any associated costs that will be the Subscriber’s responsibility.

Payment. Our products and services may be purchased with any valid credit card. Member may purchase products or services with a debit card that displays a Visa or MasterCard. Charges usually occur on the same business day but may take up to three (3) business days to be processed. If there are any complications with Member’s credit card or debit card transaction, OVC will make reasonable efforts to contact Member, but We reserve the right (without refund or credit) to cancel the confirmed booking if payment is denied by Members’ financial institution. Member will be responsible for any travel provider penalties assessed due to a payment being rejected by Member’s financial institution. To make different final payment arrangements or if Member experiences technical difficulties with the website or Member is not sure of the status of Member’s reservation or payment, please call Our concierge.

In the event that Your credit card is declined at the time that OVC attempts to process any payment contemplated by this Agreement, You hereby authorize OVC to attempt to charge such card for lesser amounts until the charge is accepted. OVC agrees to provide you with pro-rated access to benefits in the event that OVC receives a partial payment as contemplated by this Section. By charging Your credit card for a lesser amount than the amount that is due, OVC does not, and shall not be deemed to, waive its right to payment in full for any amounts payable by You to OVC.

Travel Warnings. Travel to certain destinations may involve greater risk than others. We strongly recommend you and your guests review any travel prohibitions, warnings, announcements and advisories issued by the United States Government prior to travel to international destinations. For State Department travel warnings and advisories, go to https://travel.state.gov/content/passports/en/alertswarnings.html. For foreign health requirements and dangers, go to www.cdc.gov/travel/index.htm. Other information relating to particular international destinations can be found at www.dot.govwww.tsa.govwww.faa.govhttps://travel.state.gov/content/passports/en/country.html, or www.cbp.gov.

Travel to Cuba. By traveling to Cuba on your itinerary, all travelers are attesting that they are a U.S. citizen or U.S. resident and their travel to Cuba is authorized under the Cuban Assets Control Regulations, and falls within one of the approved categories. For more information on each of the categories, please see Part 515.560 of the Cuban Assets Control Regulations at https://www.ecfr.gov. Additional information can be found at https://www.treasury.gov/resource-center/sanctions/Programs/Pages/cuba.aspx. Travel for traditional tourist activities is prohibited, and travelers are expected to maintain a full schedule of activities related to their category of travel.

Air/Sea Transportation Restrictions. When flying to reach your port of departure, we recommend purchasing the air transportation directly from the cruise line. In most cases, the cruise line will be able to make arrangements for you to reach the ship in the event of delays with your air transportation. The cruise line reserves the right to choose the air carrier, routing, flight times, and airport from each gateway city. If you book your air transportation other than through the cruise line, the cruise line or their agents assumes no responsibility for the arrangements getting to the ship or delays related thereto. Additionally, in the event you encounter any delay and miss the departure of the ship, you assume all responsibility for, but not limited to, loss of time, money or property.

Travel Insurance is Strongly Recommended. Travel insurance provides protection for the traveler in the event that your trip is canceled due to certain circumstances (for specific inclusions/exclusions, please contact the Club Concierge Department). Travel insurance may also provide coverage in the event of medical emergencies, and in some instances, pre-existing conditions. Some other benefits of purchasing travel insurance may include legal assistance, emergency medical evacuation, and travel document and ticket replacement assistance. By not purchasing travel insurance, you remain solely responsible for any cancellation costs and penalties, out of pocket expenses incurred, including any and all costs related to an emergency event while traveling.

Tickets and other Travel Documents. Travel documents will be mailed approximately 2 – 3 weeks prior to the departure date. When you receive your tickets and any and all documents, it is the sole responsibility of the passenger named on the reservation to review and verify all information. Notify the Club Concierge Department immediately if changes or corrections are required.

Fulfillment Services. The travel purchases are administered by Arrivia, Inc., d.b.a. Our Vacation Center (“OVC”). Correspondence, including confirmations, and credit/debit card charges will originate from OVC. OVC is a registered seller of travel in the following states: Florida #ST-29452, Washington UBI#602 443 155 001 0001, Hawaii #TAR-5192 (Hawaiian travel agency trust account named Client Trust Account #1 is held at First Hawaiian Bank); and California #CST 2066521-50. OVC is not a participant in the California Travel Restitution Fund. California requires certain sellers of travel to have a trust account or bond. OVC maintains a Consumer Protection Bond issued by International Fidelity Insurance Company in the amount of $100,000.00.

Liability Limits. OVC is acting as an intermediary and agent for the cruise line in selling its services, or in accepting reservations or bookings for services that are not directly supplied by this agency (such as air transportation, hotel accommodations, ground transportation, meals, tours, cruises, etc.). As a result, OVC is not responsible for its representations, or its performance hereto including any breach of contract, or any intentional or careless actions or omissions on the part of such cruise lines or travel suppliers, which result in any loss, damage, delay, or injury to you, your travel companion(s) or group members.

OVC shall have no liability whatsoever for any such injury, loss or damage, including, without limitation, any liability for consequential, incidental, punitive, or indirect damages (including, but not limited to, lost profits or lost savings), arising from, relating to, or in connection with the travel purchased from OVC, even if OVC has been advised of the possibility or could have foreseen such damages. By embarking on his/her travel, the passenger voluntarily assumes all risks involved with such travel, whether expected or unexpected.

Governing Law; Class Action Waiver; Dispute Resolution. Your travel purchase shall be governed, construed and enforced with the internal laws of the State of Arizona. Purchaser acknowledges and agrees that any proceeding to resolve or litigate any dispute arising hereunder will be conducted solely on an individual basis and shall not seek to have any dispute heard as a class action, representative action, collective action, or private attorney-general action. Purchaser further acknowledges and agrees to be bound by the terms of the Dispute Resolution Policy as posted on the website.

Cancellation. Customer may cancel a cruise confirmation by notifying OVC by telephone or in writing. OVC’s portion of customer’s payments will be forfeited in the event of cancellation. This is in addition to penalties assessed by the cruise lines, hotels, resorts, yatchs, etc. as applicable.

The passenger, by accepting this receipt and making payment towards the trip, acknowledges that they have been advised of all OVC’s and the travel provider’s terms and conditions and the importance of travel insurance and cancellation penalties, and has read and understands all the information included with the receipt. The primary passenger is solely responsible for conveying this information to all travel companions.
